Court records reveal Luciano Frattolin told the judge he wanted to take the stand in the death of his daughter, but was advised against it by counsel.

As first reported by CityNews Toronto, Luciano Frattolin has been convicted of concealment of a human corpse and second-degree murder regarding the death of his daughter, nine-year-old Melina Frattolin.

While Frattolin did not testify during the trial, CityNews Toronto reports that he expressed a desire to do so during a private conversation with Judge Tatiana Coffinger. After the prosecution rested its case, Coffinger informed Frattolin of his right to remain silent. Frattolin interrupted the judge, stating, “I trust people easily. And I trusted the cops.”

Despite being given the weekend to decide, Frattolin told the judge on the morning of the verdict, “I really want to [testify],” but added that he had been advised not to. Following this, the defense rested after calling only one witness. The jury reached a guilty verdict in approximately one hour.

CityNews Toronto reports that the jury did hear Frattolin's claims via police recordings, in which he alleged two men in a white van kidnapped the girl and suggested the mother may have orchestrated the event. Police dismissed these claims as “far-fetched.”

Essex County District Attorney Michael Langey stated that location data from Frattolin’s car and phone were pivotal in locating the body and proving guilt. First assistant district attorney Carrie Daly noted that while evidence was circumstantial, notes found in Frattolin’s vehicle mentioning “tak(ing) Melina to end” and “end(ing) her suffering” demonstrated intent.

Defense attorney Brian Pilatzke had previously asked Judge Coffinger to dismiss the case, arguing the prosecution failed to prove Frattolin was the perpetrator or intended to kill and conceal the body. Coffinger denied those motions.
